1. Who we are

These terms of service (the "Agreement") are an agreement between you and the seller of DataAttendant. The seller is C Kakoushis, a sole trader in the Czech Republic, trading as UNIT7. The address is Melnicka 6, Praha 5, 150 00, Czech Republic. You can write to us at support@dataattendant.com.

In this Agreement, "we," "us," and "our" mean the seller. "You" and "customer" mean the person or the organization that uses the Service. If you use the Service for an organization, you confirm that you may accept this Agreement for it.

2. Words used in this Agreement

  • The Service is DataAttendant: the application at app.dataattendant.com, its account pages, and the website at dataattendant.com.
  • Your files are the CSV and Excel files you open in the application, and every value in them.
  • A protected copy is a file the application writes from your file, with the treatments you chose.
  • Your saved data is what the application keeps in your browser: your types, rule sets, plans, lists, history, and Protection keys.
  • Protection keys are the keys that let you put original values back into a returned file or text. They are encrypted with your passphrase and kept in your browser.
  • A credit pays for protecting up to 10,000 records of a file. An export of 25,000 records uses 3 credits, because each started block of 10,000 counts.
  • A level is your account's plan: Starter, Professional, or Power.
  • A pack is a number of credits you buy once, without a subscription.
  • A consumer is a person who uses the Service outside their trade, business, or profession.

3. What the Service does

DataAttendant helps you prepare a file before you share it. It finds values that look sensitive, such as names, email addresses, and account numbers. You decide what happens to each type of value. You can remove it, mask it, replace it consistently, round it, shift a date, or encrypt it so that it can be restored. The application then shows a preview and a check of what remains, and writes a protected copy.

Your files are read and processed in your browser. Their contents, names, column names, and values are not sent to us or to anyone else. You can read exactly what the Service sends, and to whom, in our privacy notice.

4. What the Service does not do

These limits matter. Read them before you rely on a protected copy.

  • It shows what remains; it does not certify the result. DataAttendant does not claim that a protected copy is anonymous or anonymized. It does not claim that a protected copy, or your use of it, is compliant with the GDPR or any other law. It does not claim that a protected copy is fit for any particular purpose.
  • Detection can miss values. The application finds values by rules and patterns. It can miss a value, or a value written in an unusual way. You must check the preview and the check of what remains before you share a protected copy.
  • A protected copy may still hold personal or confidential data. This happens when a value is missed or when you choose to keep a column. It also happens when the remaining data still lets someone identify a person.
  • Restoring depends on you. Original values can be put back only with your Protection keys. Those keys are kept in your browser and opened with your passphrase or your recovery key. We never receive them. If you lose the passphrase and have no recovery key, or the browser's data is deleted without a backup, nobody can restore the values. That includes us.
  • It is not legal advice. The Service does not tell you whether you may share a file, or with whom.

5. Your account

You need an account to export a protected copy. You can open files, preview them, and restore values without one.

  • You sign in with your email address and a password, or with a code we send to that address.
  • Keep your account password to yourself, and use one that you do not use elsewhere. Your account password is not the passphrase of your saved data.
  • Tell us at once at support@dataattendant.com if you think someone else has used your account.
  • One account is for one person. Do not share your sign-in with others.
  • You are responsible for what is done with your account, unless it was used without your fault.

6. Levels, credits, and payment

6.1 Levels and credits

Every account starts at the free Starter level. Each level gives a number of credits for each period, and the paid levels cost a monthly price. The Account page and the checkout show the current levels, allowances, and prices.

  • The credits of a period's allowance end with that period. Unused allowance credits are not carried over.
  • Credits from a pack last 12 months from the day you buy them.
  • An export reserves its credits before it starts. The credits are used only when the export succeeds. A canceled or failed export uses none.
  • Opening a file, the preview, the check of what remains, restoring values, backups, and the history never use credits.

6.2 Prices and payment

Payments are made through Stripe, our payment service. Checkout shows the price, the currency, and whether tax is included before you pay. The price you see at checkout is the price you pay.

6.3 Renewal of a paid level

A paid level renews at the end of each period, for the same period, until you cancel it. Stripe charges the payment method you gave. You can cancel before the renewal, as our cancellation and refund page explains.

If a renewal payment fails, your account keeps its paid level for up to 7 days after the period ended, without a new allowance. If the payment still fails, the account returns to the Starter level. Your saved data in your browser is not affected.

6.4 Taxes

Full prices are shown at checkout before you pay.

7. Your responsibilities

When you use the Service, you agree to these responsibilities:

  • You review every protected copy before you share it. You decide what is shared, and with whom.
  • You have the right to process the data you bring. You need a lawful basis for any personal data in your files. You need permission for any confidential data.
  • You keep your passphrase, your recovery key, and your Protection keys. You make backups of your saved data on the Saved data page. You keep them where you can find them.
  • You follow the law that applies to you and to the data, and our acceptable use policy.

8. The license to use the Service

We give you a personal, non-exclusive, non-transferable license to use the Service under this Agreement, for as long as your account is open. The software, its rules, its built-in types, and its lists are licensed to you, not sold.

  • You may use protected copies and restored files without limit. They are yours.
  • You may not copy, sell, or license the Service, its rules, or its lists to others, except as the law allows.
  • You may not take the Service apart to copy it, except as the law allows.
  • The Service's rules and lists may change, or be replaced, as the Service improves. We will tell you beforehand about a change that removes something you rely on.

9. Your content and our property

Your files, protected copies, plans, and saved data belong to you. We do not receive them, and we claim no right to them.

The Service, its name, its software, its design, its rules, and its texts belong to us or to those who licensed them to us. This Agreement gives you no other right to them.

10. Confidentiality

We keep confidential what we learn about your account. We use it only to provide the Service, to bill you, and to follow the law. Our privacy notice explains what we receive and what we never receive.

11. Availability and changes to the Service

We work to keep the Service available, but it may be interrupted for maintenance, by faults, or by events outside our control. Exports need a connection to our server, because each one is checked against your credits. Opening, preview, restore, backups, and history work in your browser without our server.

We may change the Service to improve it, to keep it working, or to follow the law. We will tell you beforehand about a change that reduces what a paid level gives you.

12. Our liability

Nothing in this Agreement limits liability that the law does not allow us to limit. That includes harm to a person's life or health, and harm caused on purpose or by gross negligence.

12.1 If you are a consumer

We are liable to you as the law provides. Nothing in this section limits your right to compensation.

12.2 If you are a business customer

  • We are not liable for the content of a file you share, or for the result of sharing it. You check each protected copy before you share it (section 7).
  • We are not liable for data that cannot be restored because something was lost (section 4). That may be a passphrase, a recovery key, or the browser's data.
  • We are not liable for lost profits, or for losses that could not be foreseen when you accepted this Agreement.
  • Our total liability for all claims arising in any 12 months has a limit. It is the higher of what you paid us in the 12 months before the first claim arose, or $100.

The Service is provided as it is and as it is available, to the extent the law allows.

13. Your liability to us (business customers only)

This section applies only if you use the Service for a business. It does not apply to consumers.

You will cover our reasonable costs and losses from a third party's claim against us in two cases only:

  • the claim is about data that you processed with the Service without the right to do so;
  • the claim arises from your breach of our acceptable use policy.

We will tell you about such a claim promptly, let you take part in how it is handled, and settle it only with your agreement. You do not cover costs that we caused ourselves.

14. Suspension and ending

You may stop using the Service whenever you choose. To close your account, write to support@dataattendant.com from the address of the account. We close it within one month and confirm it to you by email.

We may suspend or close an account that breaks this Agreement or the acceptable use policy, or that puts the Service or others at risk. We will tell you why, unless the law forbids it. Where the breach can be put right, we will first give you time to put it right.

When an account is closed:

  • its credits end, and its level ends;
  • your saved data in your browser stays there, and opening, preview, and restore keep working without an account;
  • we keep only what the law requires, for as long as it requires, as our privacy notice explains.

15. Transfer to a successor company

The business behind DataAttendant is planned to move to a company that takes it over. We may transfer this Agreement, your account, and your credits to that successor company, or to another company that takes over the business.

  • We will tell you at least 30 days before the transfer, by email and on the website, and name the successor.
  • Your rights under this Agreement stay the same. The transfer does not reduce them.
  • If you do not want the transfer, you may end this Agreement before it takes effect. You then receive any refund that the law or our cancellation and refund page gives.

You agree now to such a transfer. It takes effect when we tell you about it, at least 30 days beforehand. Our privacy notice explains how your data passes to the successor.

16. Changes to this Agreement and notices

We may change this Agreement. We will tell you about a change by email and on the website at least 30 days before it takes effect. A change the law requires may take effect sooner. If you do not accept a change, you may end this Agreement before it takes effect, with no charge for ending it. A change does not affect a period you have already paid for. The version number and the date at the top of this page show which text applies.

We send notices to the email address of your account. You can send notices to us at support@dataattendant.com or to the address in section 1.

If a part of this Agreement is found invalid, the rest stays in force.

17. Law and courts

This Agreement is governed by the law of the Czech Republic, where the seller is established.

If you are a consumer, you keep the protection of the mandatory law of the country where you live. You may bring a claim in the courts of the Czech Republic or of the country where you live.

If you are a business customer, disputes go to the courts that have jurisdiction for Prague.

A consumer may also ask for out-of-court resolution of a dispute with us. The body for this is the Czech Trade Inspection Authority (Česká obchodní inspekce), at coi.gov.cz/informace-o-adr.
